A respected judge from the High Court of England and Wales has warned legal professionals about the serious risks of using artificial intelligence to create fictitious cases. Recent incidents showed that some lawyers have incorporated AI-generated content into their court submissions, raising significant concerns.
Victoria Sharp, president of the King’s Bench Division, emphasised that using AI in this way could damage the public’s trust in the justice system. Speaking during a recent judgment, she stressed that if AI tools are misused, the entire administration of justice is at risk.
The controversy arose when two cases revealed that AI technologies were deployed to prepare court documents. Although one lawyer maintained that any AI input was accidental during online research, serious questions remain about the rigour and ethical practices of those responsible.
The judge also pointed out that current guidelines are falling short in preventing such misuse. This cautionary message comes at a time when advanced AI tools like ChatGPT are increasingly common in large law firms, even as these systems occasionally generate significant inaccuracies known as “hallucinations.”
